Burger King has been in court and is looking like they will be taking the loss on this one as they have a lawsuit on their Whopper ads being misleading.
This has been in the works for around a year as it was filed in 2022 focusing on Burger Kings most popular burger is not being displayed in ads as it should be, specifically talking about the size of it, which leads to false advertising.
The suit claims that Burger King has been showing Whoppers being larger than what they are in all of their advertisement from TV ads – to their online pages, where if you go yourself to get one they will look like a child’s burger in comparison to what they promote.
This lawsuit also claims Burger King has gotten rich off of their patrons and they violate loads of laws and regulations that all food joints have to follow.
The judge has signed off on some parts of the lawsuit but left off some. Hizzoner says that BK will not have to answer about the claims towards their ads, where the plaintiffs say that played a big part in the scheme, they also will not have to combat with the consumer-protection law claims.
Per Burger Kings request those parts were thrown out of the lawsuit, other parts of the lawsuit that BK wanted to be thrown out were kept in which is bad news for the King.
The claims that were left in were some major ones which is breach of contract, negligent misrepresentation and unjust enrichment. Even though the judge tossed out the tv ads and online ads, they still have print ads as well as, the menu photos which they claimed were made to look bigger.
Burger King’s result will end up being on the jury and the people will have the final say.
